ALEXANDRIA, VA. - 08/01/08 – In Todd v. United Way of America, Judge Leonie Brinkema of the U.S. District Court for the Eastern District of Virginia denied a motion for summary judgment brought against Hazel Todd, a client of The Employment Law Group® law firm, allowing Ms. Todd to proceed to trial with her claim for retaliation under the Family Medical Leave Act (“FMLA”). In her complaint, Ms. Todd, a former manager of the United Way’s Disaster Preparedness, Response and Recovery Team, alleged that the United Way retaliated against her by terminating her employment after she exercised her right to family and medical leave granted under the FMLA.
R. Scott Oswald and Nicholas Woodfield of The Employment Law Group® law firm in Washington, D.C. are representing Ms. Todd’s claim under the anti-retaliation provisions of the FMLA. The United Way is being represented by Ray Baldwin and Jessica Hughes of Seyfarth Shaw LLP. The case is scheduled to go to trial on September 8, 2008.
